Body found in Marion County

The body of a 30-year-old McPherson man was found Monday near Marion Reservoir by authorities conducting a search as part of the investigation of a vehicle fire Sunday evening.

Dustin Smith, 24, of McPherson, has been charged with the premeditated first-degree murder of Justin John Milne.

Authorities believe Milne was killed Sunday in McPherson. An autopsy completed at the Sedgwick County Regional Forensic Center determined the cause of death to be multiple gunshot wounds.

Milne’s vehicle, a 1998 Chevrolet Tahoe, was driven to a deserted area near 220th and Kanza roads near Marion Reservoir on Sunday and set on fire. Smith was found in the area near the vehicle. Milne’s body was found 1.5 miles northeast of the location of the burned vehicle.

Smith and another person were detained for questioning Sunday evening. According to Sheriff Robert Craft, one person was transported to McPherson County Jail and one was detained at the Marion County Jail and then transported Monday to McPherson. Murder charges will not be filed against the second suspect but it was not known if any charges will be filed.

The victim had connections to Marion County, Craft said.
