Victorinus G. Burgardt, possession of hallucinogen, obstructing legal process in misdemeanor case, purchase or consumption of alcohol by a minor, and transporting an open container; defendant pleaded no contest to count one, county attorney made motion to dismiss all remaining counts with prejudice, pursuant to plea. Defendant was sentenced to a controlling sentence of 30 days in custody of Marion County Sheriff, which was suspended. Defendant was placed on immediate supervised probation with court services officer for one year, which can be transferred to Ellis County. Defendant will serve 48 hours in the county jail for every positive drug/alcohol test, refusal to submit, or admission of use; must refrain from the use of alcohol or drugs and submit to a blood, breath, or urine test upon request of a court services officer or law enforcement officer, ordered to obtain a drug and alcohol evaluation and follow all recommendations at own expense, refrain from use of alcohol or illegal drugs, no contact with victims, and ordered to pay court costs of $138, a surcharge of $10, probation fee of $25, booking fee of $45, and court-appointed attorney fees as determined by the court. All fees must be paid within nine months.

Walter G. Lacy IV, flee or attempt to elude a law enforcement officer by engaging in reckless driving and exceeding maximum speed limits; defendant entered diversion agreement requiring defendant to pay $125 diversion fee, $138 court costs, $10 surcharge, $200 fine for count one, a fine of $66, and booking fee of $45. All costs must be paid within 60 days. Diversion agreement will terminate within six months if defendant completes terms and conditions.
