Criminal Division

The following information has been filed in the criminal division of Marion County District Court:

Sidney Eugene Newton II, arraignment hearing at 1:15 p.m. May 20.

Donald Jeffrey Richmond, criminal threat, domestic battery (violation date of March 29); first appearance hearing held, bond was continued.

Steven Michael Detjen, nine counts of criminal use of financial card with a value less $1,000, two additional counts of criminal use of financial card with a value less than $1,000 were amended to attempted criminal use of a financial card; first appearance hearing held, defendant was found indigent or partially indigent and the court appointed attorney Dan Baldwin, bond was set at $10,000; arraignment hearing at 10:30 a.m. June 1.

Lloyd D. Meier, assault, disorderly conduct; first appearance hearing at 10:30 a.m. June 1.

Stephanie R. Oswald, giving a worthless check less than $1,000; upon motion of the county attorney, the case was dismissed without prejudice and costs assessed to the state.

Jennifer Wyss, possession of hallucinogenic, possession of simulated controlled substances or drug paraphernalia, DUI, obstructing legal process in misdemeanor case, failure of duty of driver to report upon damaging unattended vehicle (violation date of Feb. 26); bench trial at 9 a.m. June 23.

Jennifer Neufeld, original charge of sale or possession with intent to sell hallucinogen was amended to possession of hallucinogenic, other charges were no drug tax stamp as required, possession of simulated controlled substances or drug paraphernalia; sentencing at 11 a.m. June 15.

Douglas Bryant Eden, violation of a protective order, harassment by telephone (violation date of Jan. 17); status hearing at 8:30 a.m. Sept. 8.

Rodney D. Leshure, disorderly conduct (violation date of Nov. 27, 2008); bench trial at 1:15 p.m. June 22.

Chris Lieder, burglary of a building used as a dwelling, attempted theft with a value less than $1,000 (violation date of Dec. 8, 2008); jury trial to begin 8:30 a.m. June 25.

Megan S. Soyez, four counts of giving a worthless check less than $1,000; defendant pleaded no contest to count one, upon motion of the county attorney, all remaining charges were dismissed with prejudice; defendant was sentenced to a controlling sentence of 90 days in the custody of Marion County Sheriff which was suspended; defendant was placed on immediate unsupervised probation for 12 months, ordered to pay court costs of $137, booking fee of $45, and restitution of $655.21, and shall not maintain a checking account during pending case.

Anthony R. Buchanan, original charge of criminal threat was amended to domestic battery; defendant and county attorney enter into a diversion agreement, upon completion of diversion, charges will be dismissed without prejudice, if terms of diversion are violated, agreement will be used as evidence in a trial on charges and will be sufficient to convict the defendant as charged, defendant agreed not to violate any laws, complete an anger management class, and pay a diversion fee of $125, court costs of $137, and court-appointed attorney fees of $200, with all fees paid within 60 days.

Harley Brammer, possession of opiates, opium, or narcotic drugs, possession of hallucinogenic (one prior conviction), no drug tax as required, possession of simulated controlled substances or drug paraphernalia; sentenced to a controlling term of 15 months with the Secretary of Corrections for count one and 11 months with the Secretary of Corrections for count two, sentences are to run consecutive, placed on supervised probation with community corrections for 12 months and is to receive mandatory drug treatment; defendant ordered to maintain abstinence from all mood-altering chemicals, continue individual and family therapy, not to enter any establishment with primary source of income from alcohol, submit to random blood, breath, or urine testing, repay court costs of $172, probation fee of $50, KBI lab fee of $400, attorney fee of $725, and KBI DNA fee of $100.

Dustin Ray Smith, original charges of criminal possession of explosives, burglary, theft by deception of more than $500 and less than $25,000 (violation date of Feb. 14, 2005); preliminary hearing at 9:30 a.m. June 3.

Andrew M.
