Tower appeal filed

Darvin Markley filed an appeal to the City of Marion on the administrative decision by City Administrator Doug Kjellin about the Marion County radio tower planned to be installed as an accessory structure to the county jail building.

Markley said that Kjellin did not have the authority under zoning regulations to make a decision without the motion being placed to the proper board and the evidence presented.

Markley owns the property where he alleges the proposed 92-foot tower may fall in case of severe weather. Marion County commissioners have said that the tower would be far enough away where it would not fall on Markley’s property.

The zoning board of appeals will hold the hearing Sept. 6, 22 days after the meeting date is officially published.

Zoning Administrator Marty Federickson said Markley would have to abstain from voting during the hearing. Markley is the chairman of the Zoning Board of Appeals.
