Accessory building ordinance clarified

An ordinance that allows accessory buildings larger than 1,200 square feet was approved by Marion City Council at the Feb. 9 meeting.

Confusion was expressed by the council and those in attendance at the meeting regarding the protocol of the allowance.

By ordinance, the city's board of zoning appeals reviews and approves or denies applications for variances from the city's zoning regulations which includes larger garages in residential areas. That decision is final. If the applicant is not pleased with the decision made by the zoning appeals board, the issue then is taken to Marion County District Court, not the city council.

The ordinance that recently was approved by the council gave the council authority to "reserve the right to allow an alternate building plan if such plan is presented to the city board of zoning appeals and is thereby approved. . ."

In the end, it was determined that any building variance would go through the board of zoning appeals application process.
