Attorney claims appeal request not placed on city agenda

During the public forum at Monday's Marion City Council meeting, attorney David Page of McPherson, addressed the council.

He said he represented former Marion Police Officer James Parmley. After Parmley was terminated by the city Aug. 3, Page said a letter was taken to the city that requested an appeal hearing at the next council meeting regarding Parmley's dismissal. Page said the request was either not placed on the agenda or it was placed and removed from the agenda.

Marion Mayor Mary Olson told Page that he needed to talk with city attorney Dan Baldwin about the matter. Page responded that he wanted his statements to be reflected in the council's minutes.

Parmley and his wife, Melissa, also were in attendance at the meeting.

In other business:

— A public hearing was held regarding the 2008 city budget. There were no questions or comments made by the public.

Later in the meeting, the council approved the budget which is an increase of 3/10ths of a mill.

— The council also approved an electrical license for Rick Lowe of A&H Electrical, Inc., Wichita, a plumbing license for Carroll Harder of Harder Family Construction of Newton, standard traffic ordinance, uniform public offense code, a change order for $9,844 and payment of $12,454 to Walters Morgan for the water plant project, and a contract with engineering consultants Kirkham Michael for the Community Development Block Grant application for street improvements on Eisenhower Drive and North Cedar Street.

— Councilman Bill Holdeman requested a 40-minute executive session to discuss personnel policies. Baldwin said city policies were not executive session material.

Holdeman continued that a sample personnel policy handbook from the City of Derby that was being reviewed by the council gave the city administrator "all of the power." Baldwin said the sample policy was "food for thought."

Olson suggested the council continue to review the sample policy and have a work session to discuss options.

A work session was planned for 4:30 p.m. Monday at the city building.
