I am writing in response to the article in the April 16 Marion County Record, page 13, regarding "County wants way to combat CKC, protect landowners."

In that article it states, "City of Marion administrator David Mayfield had been contacted and asked by Holub if there was a contract between CKC and the city as CKC attorney Mike Mills stated at the previous meeting. Mayfield responded there was no agreement."

There is a contract with CKC and the City of Marion for use of the rail bank from Main Street to the dike.

I was present at the previous county commission meeting where Mike Mills, attorney for CKC, did state that CKC had an agreement with the City of Marion for use of the rail bank from Main Street to the dike. When I visited with Commissioner Holub, I confirmed that statement. I did go on to inform Commissioner Holub that the abandoned railroad right of way from Third Street to Main Street was deeded to the City of Marion by the railroad and therefore there was no contract with CKC regarding that portion of the trail in Marion. However, there is a contract with CKC for use of the rail bank from Main Street to the dike.

Evidently there was a miscommunication somewhere and a clarification needed to be made.
