Criminal division
The following information has been filed in the criminal division of Marion County District Court:
Stacey R. Neufeldt, giving a worthless check less than $500; first appearance hearing at 10:30 a.m. April 21.
Wayne Kenel, domestic battery; upon motion of the county attorney the case is dismissed without prejudice because of a plea in a Marion County traffic case, costs are assessed to the state.
Marvin R. Schwertfeger, battery, disorderly conduct; upon motion of the county attorney the case is dismissed without prejudice and costs are assessed to the state.
Brandon S. Kenneson, original charges of six counts of aggravated burglary, three counts of burglary of a building not used as a dwelling, eight counts of theft by deception of less than $500, criminal damage to property less than $500 (violation dates were August and September 2005); hearing was held to revoke probation, court found defendant had violated his probation by failure to report as directed, failure to remain drug free, failure to complete treatment, failure to maintain full-time employment, failure to remain crime-free, the court revoked the defendant's probation and ordered him to serve 30 consecutive days in the custody of the Marion County Sheriff, reinstated the defendant's supervised probation for the remainder of the original term with community corrections and shall be subject to all original terms and conditions, probation can be transferred to Sedgwick County.
Norma Elizabeth Ines, two counts of contributing to a child's misconduct was amended to two counts of aiding a felon, aiding a felon was amended to possession of simulated controlled substances or drug paraphernalia, possession of simulated controlled substances or drug paraphernalia was amended to possession of stolen property with a value less than $500, two additional charges of possession of stolen property with a value of less than $500; preliminary hearing continued to 9:30 a.m. June 4.
Joshua Vines, original charges of possession of depressants, stimulants, hallucinogenics, anabolic steroids, possession of simulated controlled substances or drug paraphernalia (violation date of June 1, 2006); probation revoked and reinstated because defendant failed to make regular payments, failed to complete community service work, and failed to successfully complete treatment.
Joseph L. Shaver, burglary of a motor vehicle, theft of less than $1,000, criminal damage to property of less than $500; defendant sentenced to a controlling sentence of six months for count two and a controlling sentence of 90 days for count three to be concurrent to each other and concurrent with Dickinson County time that he is serving in the department of corrections, defendant ordered to pay court costs of $128, court-appointed attorney fees of $534.05, and restitution of $97.80, the defendant has 30 days after his release from the Department of Corrections to pay all fees.
