William M. Hess, sale or possession with intent to sell hallucinogens amended to possession of depressants/stimulants/hallucinogenics, steroids, possession of paraphernalia to grow, distribute marijuana, no drug tax, possession of simulated controlled substances or drug paraphernalia; defendant sentenced to a controlling term of six months with the Secretary of Corrections for count three and 12 months with the Marion County Sheriff for count one, placed on immediate supervised probation with court services for 12 months to run concurrent with each other, complete 15 hours of community service work, cannot possess or consume alcohol or illegal drugs, submit to random blood, breath or urine testing upon request of court services officer or any law enforcement officer, notify CSO of changes in employment, residence, and phone number, submit DNA registration and be responsible for all costs associated with the registration, obtain a drug and alcohol evaluation at own expense and follow recommendations at own expense, ordered to serve 48 hours in Marion County Jail for every positive drug/alcohol testing, refusal to submit, failure to follow the UA testing instructions, or admission of usage, must pay $163 for court costs, $50 probation fees, $625 attorney's fees, and $100 other fees.
