The following information has been filed in the Criminal Division of Marion County District Court:
John Wayne McCullick, domestic battery, battery, criminal damage to property less than $500; defendant appeared from probable cause arrest and is indigent, court appointed attorney Dan Baldwin, bond set at $1,000 cash/cash surety, ordered to have no contact with victim; arraignment at 9:45 a.m. June 18.
Keith A. Buelow, preliminary hearing at 9:30 a.m. June 27.
Jacob M. Poore, purchase/consumption of alcoholic liquor by a minor; first appearance at 10:30 a.m. June 18.
Charles D. Rumsey, aggravated indecent liberties with a child under the age of 14; first appearance held, defendant did not appear and is indigent, court appointed attorney Doug Jones.
Derek R. Swiercinsky, diversion agreement with order of continuance and dismissal (12 months), deferred adjudication of possession of depressant/stimulants/hallucinogenics/steroids, possession of simulated controlled substances or drug paraphernalia, purchase/consumption of alcoholic liquor by a minor, court ordered restricted driver's license.
Kevin C. Randy Herbel, rape, sexual intercourse with a child under the age of 14 (violation date of Aug. 1, 2006); rape, sexual intercourse with a child under the age of 14, aggravated indecent liberties with a child under the age of 14 (violation date of Aug. 2, 2006); motion hearing held, pretrial motions at 3 p.m. June 27.
Jesse A. Boucher, diversion agreement with order of continuance and dismissal; deferred adjudication of possession of depressant/stimulants/hallucinogenics, steroids, possession of simulated controlled substances or drug paraphernalia, court ordered restricted driver's license.
Gary Wayne Stegman, diversion agreement with order of continuance and dismissal (12 months); deferred adjudication for criminal trespass.
Cathy D. Martin, battery against a law enforcement officer, disorderly conduct, assault; defendant waived rights and pleaded guilty to disorderly conduct and sentenced to a controlling sentence of 10 days in custody of Marion County Sheriff; placed on immediate unsupervised probation for 12 months, probation is subject to all standard terms/conditions and special conditions that include defendant to complete an evaluation to determine whether she needs anger management therapy; if defendant fails to complete evaluation and follow recommendations she shall be placed on supervised probation for 12 months subject to all standard terms and special condition that she not enter Marion City Office for one year; defendant is to pay court costs of $128 and court-appointed attorney fees as determined by the court.
Casey Purk, arraignment hearing held, defendant pleaded no contest to domestic battery and sentenced to a controlling sentence of 30 days in custody of Marion County Sheriff and shall serve 48 hours of said time, placed on immediate supervised probation with court services officer for six months, probation subject to all standard terms and conditions with special term for defendant to serve 48 hours in county jail for every positive drug/alcohol test, refusal to submit, or admission of usage, defendant to pay court costs of $128, probation fee of $45, and court-appointed attorney fees as determined by the court.
Joshua Esau, defendant waived probation violation hearing and stipulated to allegations by the state, defendant found to be in violation of probation by failure to obtain a drug/alcohol evaluation and failure to pay fees owed; probation revoked, court sentenced defendant to 90 days in custody of Marion County Sheriff and given credit for time served; said time shall be a condition of being placed back on supervised probation; defendant's probation is reinstated for 12 months upon the release from custody/treatment with CSO, said probation shall be subject to all original standard terms/conditions with special condition that defendant shall complete a drug/alcohol evaluation while in custody and follow all recommendations at his own expense; defendant shall pay any additional court-appointed attorney fees as determined by the court.
Daniel Lee Tucker, diversion status check rescheduled for 10:30 a.m. June 25.
Billie J. Fleming, possession of opiates, opium, or narcotic drugs, possession of depressants, stimulants, hallucinogenics, anabolic steroids, possession of simulated controlled substances or drug paraphernalia (violation date of May 19, 2006); possession of opiates, opium, or narcotic drugs, attempted possession of depressants, stimulants, hallucinogenics, steroids, possession of simulated controlled substances or drug paraphernalia (violation date of Aug. 24, 2006); jury trial rescheduled to 8:30 am. Aug. 8.
Paul C. Hill Jr., giving a worthless check less than $500; upon motion of county attorney case dismissed without prejudice.
Charlene R. Bram, solicitation to sell opiates, opium, narcotic drugs, endangering a child under the age of 18, possession of depressant, stimulants, hallucinogenics, steroids, possession of simulated controlled substances or drug paraphernalia; upon motion of county attorney, matter dismissed without prejudice and costs assessed to state.
Dennis W. Hancock, two counts of theft by deception of less than $500, three counts of criminal deprivation of property; upon motion of county attorney, case dismissed without prejudice and costs assessed to the state.
