The following information has been filed in the criminal division of Marion County District Court:

Derek D. Summers, domestic battery/physical contact by family member; first appearance hearing held, defendant is partially indigent, court appointed attorney Don Snapp, bond was set at $1,500, conditions of the bond were no contact with the victim, no alcohol or drugs, and willingness to submit to testing upon bonding; arraignment at 11 a.m. July 21.

Jennifer Rene Hubbard, criminal damage to property more than $500 and less than $25,000; first appearance hearing at 10:30 a.m. July 28.

Byam A. Lacy, possession of opiates, opium, or narcotic drugs, possession of simulated controlled substances or drug paraphernalia; first appearance hearing held, defendant is indigent or partially indigent, court appointed attorney Brent Boyer, bond set at $10,000; preliminary hearing was set for July 9 and then continued to 9:30 a.m. Aug. 6.

David Lee Johnson, burglary of a building used as a dwelling, theft of less than $1,000, unlawful acts with a vehicle; defendant is indigent or partially indigent, court appointed Don Snapp, bond was set at $10,000, bond conditions consistent with Butler County bond, no contact with individual; preliminary hearing was set for July 9 and continued to 9:30 a.m. Aug. 27.

April N. Johnson, defendant is indigent or partially indigent, court appointed Dan Boyer, bond set at $10,000, bond conditions consistent with Butler County, no contact with individual; preliminary hearing was set for July 9 and continued to 9:30 a.m. Aug. 6.

Jordan Reid Allen, possession of depressants, stimulants, hallucinogenics, steroids, purchase/consumption of liquor/cereal malt beverage by a minor (violation date of March 6); first appearance hearing held; defendant was found indigent or partially indigent, court appointed attorney David Harger, summons continued; arraignment at 3:30 p.m. July 28.

Mary Alice Hewitt, theft of less than $1,000; upon motion of the county attorney, the case was dismissed without prejudice with costs assessed to the county.

Mark Daniel Jarrett, theft of less than $1,000; upon motion of the county attorney, the case was dismissed without prejudice and costs assessed to the county.

James Wullenweber, giving a worthless check less than $500; upon motion of the county attorney the case was dismissed without prejudice, defendant had paid court costs and restitution.

Conan Mader, disorderly conduct, purchase/consumption of alcoholic liquor/CMB by a minor; defendant pleaded not guilty to the charges, jury trial was held July 8.

Stacey R. Neufeldt, giving a worthless check less than $500; upon motion of the county attorney the case was dismissed without prejudice, defendant paid court costs and restitution.

Ray E. Andrews, probation revocation (fourth conviction); original charges were fleeing or attempting to elude a law enforcement officer (third conviction), DUI (second conviction), assault on a law enforcement officer (violation date of Aug. 5, 2001); defendant sentenced to six months with Kansas Department of Corrections, after released from prison, defendant is to serve 12 months of supervised probation.

Jordan Reid Allen, purchase/consumption of alcoholic liquor/CMB by a minor (violation date of Feb. 20); hearing rescheduled to 3:30 p.m. July 28.

Stacey R. Neufeldt, criminal depravation of property, criminal damage to property less than $500 (violation date of Feb. 22); jury trial to begin at 8:30 a.m. Oct. 28.

Dominic Louie Voelker, preliminary hearing at 9:30 a.m. Aug. 6.

Debbie J. Orcutt, jury trial to begin at 8:30 a.m. Oct. 9.

Michael E. Richmond, assault (violation date of Dec. 13, 2007); jury trial continued to 8:30 a.m. Aug. 14.

Michael G. Hemmer, DUI (third conviction); sentenced to 12 months in Marion County Jail which was suspended, defendant is granted probation after serving five days in jail (three consecutive weekends) and 120 days under house arrest, placed on probation for 12 months with community corrections officer, ordered not to possess or consume alcohol or illegal drugs, not to drive unless he has a valid driver's license and a properly tagged and insured vehicle, must submit to random blood, breath, or urine testing upon the request of his court services officer or any law enforcement officer, notify the ISO of changes in employment, residence, and phone number, not to enter any establishment whose primary source of income is derived from the sale of alcohol or cereal malt beverages, submit to DNA registration and responsible for costs associated with registration, obtain a drug and alcohol evaluation at his own expense and follow all recommendations at own expense, will serve 48 hours in Marion County Jail for every positive drug/alcohol testing, refusal to submit, or admission of usage, pay $163 court costs, $50 probation fee, $1,500 fine, $45 booking fee, and $625 for court-appointed attorney fees

Norma Elizabeth Ines, two counts of contributing to a child's misconduct were amended to aiding a felon, aiding a felon was amended to possession of a simulated controlled substances or drug paraphernalia, possession of simulated controlled substance or drug paraphernalia was amended to possession of stolen property with a value less than $500, two counts of possession of stolen property with a value less than $500; defendant pleaded no contest to counts four and five, upon motion of county attorney counts one, two and three were dismissed with prejudice; defendant sentenced to six months in jail which was suspended if defendant pays court costs of $163 and court-appointed attorney fees of $573.69 within six months. If the defendant does not have contact with law enforcement for the next six months, then the matter will be terminated. If defendant does not pay fees owed or has contact with law enforcement, the court could sentence defendant.

Darcy Benjamin Funk Unrau, defendant will retain private counsel, bond continued; arraignment held July 8; diversion status check hearing at 9:45 a.m. Aug. 12.

Richard J. Chaput, original charges of two counts of giving a worthless check of less than $500; bench warrant for failure to appear; bond appearance rescheduled to 10:30 a.m. Aug. 12.

David M. Gore, motion to revoke probation, original charges of possession of depressant, stimulants, hallucinogenics, steroids, possession of simulated controlled substances or drug paraphernalia (violation date of Jan. 3, 2006); defendant is indigent or partially indigent, court appointed attorney David Harger, defendant is to pay $25 by Aug. 1, and every month until further notice, bond was continued; arraignment hearing at 9:45 a.m. July 28.

Richard Todd Litton, motion to revoke probation, original charges of aggravated robbery amended to assault, battery was amended to possession of depressant, stimulants, hallucinogenics, steroids, theft by deception under $500 (violation date of Nov. 21, 2006); defendant is indigent or partially indigent, court appointed attorney Dan Baldwin, bond was continued, arraignment hearing at 9:45 a.m. Aug. 12.

Joshua Vines, motion to revoke probation, original charges of possession of depressants, stimulants, hallucinogenics, anabolic steroids, possession of simulated controlled substances or drug paraphernalia (violation date of June 1, 2006); defendant is indigent or partially indigent, court appointed attorney Dan Baldwin, bond was continued; arraignment hearing at 9:45 a.m. Aug. 12.

Joshua Vines, motion to revoke probation, original charges of sale or possession with intent to sell depressants, no drug tax, possession of simulated controlled substances or drug paraphernalia, operating a motor vehicle without a valid license (violation date of April 9, 2006); defendant is indigent or partially indigent, court appointed attorney Dan Baldwin, bond was continued; arraignment hearing at 9:45 a.m. Aug. 12.

Dennis Britton Jr., original charges of two counts of burglary of a building used as a dwelling amended to criminal trespass, two counts of burglary of a building used as a dwelling, theft of a value of at least $1,000 but less than $25,000 amended to theft of a value less than $1,000; hearing rescheduled to 10 a.m. July 21.
