The following information has been filed in the criminal division of Marion County District Court:

Michael G. Hemmer, DUI, endangering a child under the age of 18, transporting an open container, refusal to submit to a preliminary breath test, defective tail lamp on motor vehicle; bond appearance at 1:45 p.m. Dec. 19.

Marcus Abe Penner, eavesdropping; first appearance at 10;30 a.m. Dec. 3.

Albert D. Banks, sale or possession with intent to sell hallucinogenics, possession of opiates, opium, or narcotic drugs, no drug tax as required, possession of simulated controlled substances or drug paraphernalia; pleaded guilty to possession of cocaine, counts one, three, and four were dismissed by county attorney; sentencing at 11 a.m. Jan. 7, 2008.

Nikos R. Starks, diversion status check rescheduled to 1:45 p.m. Dec. 19.

Bryan Ray Stoll, arraignment at 9:45 a.m. Jan. 15, 2008.

Dennis Britton, preliminary hearing rescheduled to 9:30 a.m. Dec. 19.

Daniel L. Schmidt, sentencing at 1:15 p.m. Jan. 7, 2008.

Adam B. Collett, domestic battery, criminal damage to property less than $500; upon motion of county attorney, the case is dismissed without prejudice and costs assessed to the state.

Nicholas J. Ogden, theft of less than $1,000; upon motion of county attorney, the case is dismissed without prejudice and costs assessed to the state.

Michael L. Bass, domestic battery; upon motion of the county attorney, the case is dismissed without prejudice and costs assessed to the state.
