The following information has been filed in the criminal division of Marion County District Court:

Donald R. Phillips Jr., possession of depressants, stimulants, hallucinogenics, anabolic steroids, possession of simulated controlled substances or drug paraphernalia.

Marcus Abe Penner, arraignment at 2 p.m. Dec. 17.

Charles A. Adams, preliminary hearing rescheduled to 9:30 a.m. Jan. 16, 2008.

Kelly Defreese, bond appearance held, court appointed attorney Donald Snapp; sentencing at 1:15 p.m. Dec.19.

Anthony Helzer, two counts of giving a worthless check less than $500; upon motion of county attorney the case is dismissed with prejudice; defendant ordered to pay restitution, court costs and attorney's fees from another case.

Gary Lee McCloud Jr., first appearance rescheduled to 10:30 a.m. Dec. 17.

Anthony Alexander Ebaben, arraignment hearing rescheduled to 9:45 a.m. Dec. 17.

Lamonte P. Davis jr., arraignment rescheduled to 9:45 a.m. Dec. 17.

Austin Wade Evans, criminal damage to property less than $500; entered into a diversion agreement, with successful completion of the agreement, charges will be dismissed within six months. conditions included payment of $125 diversion fee, $128 court costs, $150 attorney fees, and restitution of $150; all costs and fees are to be paid within 60 days; if money is not paid within the 60 days, prosecution will resume.

Deborah Nickel, arraignment rescheduled to 9:45 a.m. Dec. 17.

Cory Hemstead, sentencing at 11 a.m. Jan. 30, 2008.

Dennis Britton, preliminary hearing rescheduled to 9:30 a.m. Dec. 19.

Connie Sheffler, two counts of giving a worthless check less than $500; defendant was placed on unsupervised probation for six months, ordered to meet with community services officer one time to establish a payment contract and ordered to pay court costs within six months.

Clifton Richmond, sentencing at 11 a.m. Dec. 17.

Roscoe Jay Czarnowsky, defendant had served 116 days in the custody of Marion County Jail after being arrested July 18, bonded on Aug. 1, arrested again Aug. 16 and bonded Nov. 26.

Angela M. Jordan, giving a worthless check less than $500; upon motion of the county attorney, the case is dismissed without prejudice, defendant ordered to pay court costs.

John Wayne McCullick, arraignment rescheduled to 9:45 a.m. Dec. 17.

Melanie Saretta Stephen, failure to appear, bond appearance at 10:30 a.m. Dec. 17.

Rauh, manufacturing controlled substance, possession of opiates, opium, or narcotic drug, theft by deception of $500 to $25,000, possession of simulated controlled substances or drug paraphernalia, possession of depressants, stimulants, hallucinogenics, steroids, theft by deception of less than $500, trespassing on railroad property without consent of owner (violation date of July 26, 2006); hearing at 1:15 p.m. Jan. 15, 2008.

Billie J. Fleming, possession of opiates, opium, or narcotic drugs, possession of depressants, stimulants, hallucinogenics, anabolic steroids, possession of simulated controlled substances or drug paraphernalia (violation date of May 19, 2006); journal entry of conviction and sentencing, defendant pleaded guilty to count three, county attorney dismissed counts one and two, defendant sentenced to six month controlling sentence in the custody of Marion County Sheriff to be concurrent to another Marion County case and a Harvey County case; defendant to pay court costs of $128 and KBI lab fee of $200.

Rochelle D. Atwood, original charge of burglary amended to misdemeanor theft, theft by deception of $500 to $25,000 amended to theft of less than $1,000, theft by deception of less than $500; journal entry of sentencing, defendant sentenced to a controlling sentence of 60 days for count one and a controlling sentence of 60 days for count two to be served consecutive to each other in the custody of Marion County Sheriff, defendant ordered to serve 14 days to be completed prior to beginning probation, defendant placed on immediate supervised probation for one year for each count to be concurrent to each other with CSO; shall serve 48 hours in Marion County Jail for every positive drug/alcohol test, refusal to submit, or admission of usage; shall not enter any establishment whose primary source of income is from the sale of alcohol or cereal malt beverage, shall complete 15 hours of community service work, no contact with victims, and pay court costs of $128, probation of $25, booking fee of $45, restitution of $100, and court-appointed attorney fees.

Fleming, posession of opiates, opium, or narcotic drugs, attempted possession of depressants, stimulants, hallucinogenics, steroids, possession of simulated controlled substances or drug paraphernalia (violation date of Aug. 24, 2006); defendant pleaded guilty to count three, county attorney dismissed counts one and two, defendant ordered to serve a six-month controlling sentence in custody of Marion County Sheriff to be concurrent to another Marion County case and Harvey County case; defendant ordered to pay court costs of $128 and fees of $100.
