Criminal division

The following information has been filed in the criminal division of Marion County District Court:

Joshua D. Clark, assault, disorderly conduct; bond appearance at 10:30 a.m. Dec. 17.

Shannon Lee Eden, giving a worthless check less than $500; upon motion of county attorney the case was dismissed without prejudice because defendant had paid court costs, booking fee, and restitution.

Timothy G. Brown, giving a worthless check less than $500; upon motion of the county attorney the case was dismissed without prejudice because the defendant had paid court costs, restitution, and booking fee.

Connie S. Sheffler, two counts of giving a worthless check less than $500; defendant pleaded guilty to count one, upon motion of county attorney count two was dismissed with prejudice, defendant sentenced to a 60-day controlling sentence, the court placed the defendant on immediate unsupervised probation for a period of six months, defendant ordered to pay court costs of $128, booking fee of $45, and restitution of $173.86; ordered to complete the Credit for Life class and not maintain a checking account during the length of probation.

Roscoe J. Czarnowsky, domestic battery; defendant pleaded no contest, court services officer ordered to prepare a pre-sentence investigation report by sentencing hearing at 1:15 p.m. Dec. 19.

Nicholas Shaun Davis, possession of opiates, opium, or narcotic drugs, no drug tax stamp as required, possession of depressants, stimulants, hallucinogenics, possession of simulated controlled substances; charges two and four were dismissed; pleaded guilty to charges one and three, sentenced to 11 months with Kansas Department of Corrections for count one and 60 days in Marion County Jail for count three, placed on supervised probation with community corrections for 18 months to run concurrent, is not to have contact with victim, not to possess or consume alcohol or illegal drugs, ordered to submit to random blood, breath, or urine testing, and other requirements, mandatory drug treatment up to 18 months, ordered to pay court cost and fees for a total of $1,203.

Keith Buelow, sale or possession with intent to sell hallucinogen, possession of opiates, opium, or narcotic drugs, aggravated escape while being held on a felony charge, no drug tax stamp as required, possession of simulated controlled substances or drug paraphernalia; sentenced to a controlling term of 11 months with Kansas Department of Corrections for count two, five months with KDOC for count four, and 30 days with Marion County Sheriff for count five. Placed on supervised probation for 18 months with community corrections for counts two and four, and six months for count five, mandatory drug treatment, sentences to run consecutive, probation to run concurrent, total costs and fees $1,488, not to possess or consume alcohol or illegal drugs, ordered to submit to random blood, breath, or urine testing, and other requirements, and other stipulations.
