Truck driver charged in quintuple fatality crash

Richard F. Duncan Jr., 35, has been arrested and charged with five counts of vehicular homicide as a result of a collision June 29, 2004, on U.S.-50.

According to an accident report written by Kansas Highway Patrol Trooper S.M. Proffitt, Duncan was driving a tractor-trailer westbound on U.S.-50 and failed to stop for other westbound traffic already stopped for road construction.

As a result of the collision, a family from Wright and a couple from Wichita died at the scene.

Killed in the incident were Victoria A. Bogner, 43, Christopher G. Bogner, 21, and Charlie M. Bogner, 17, all of Wright; John R. Cafferty, 56, and Shirley A. Cafferty, 51, both of Wichita.

Duncan had been incarcerated at Big Muddy Correctional Center, Big Muddy River, Ill., on related charges. He will be extradited to Marion County for a first appearance at 10:30 a.m. Sept. 12, in district court at Marion County Courthouse.

Vehicular homicide is classified as a misdemeanor.

This incident was the third of three deadly crashes that summer that involved tractor trailers and a construction zone on U.S.-50.
