Use fireworks responsibly
Marion residents are reminded by officials to use common sense and good judgment this coming weekend.
The sale and discharge of some fireworks within the city limits of Marion are allowed after the adoption of an ordinance in June 2004.
The ordinance allows the sale and discharge of "common fireworks."
"Bottle rockets are illegal anywhere in the state," explained police chief Michel Soyez. Large roman candles also are not permitted in the city due to fire risk.
"There is always a concern of fire in residential and business areas," Soyez said. "This year there has been plenty of rain so we aren't as concerned.
"The fire chief inspects the fireworks stands and advises vendors if there are unallowable items," said Soyez.
Requirements to sell fireworks:
— Applications are required to be filed 21 days before retail sales are to begin. The applications are approved by Marion City Commission.
— Included with the applications are proof of at least $200,000 liability insurance and $200,000 of property damage coverage.
— Also required are copies of vendor's Kansas sales tax license.
— All retail sales locations must be supervised by people who are at least 18 years of age.
— No sales can be made to those under the age of 16 unless accompanied by an adult.
— Each temporary stand must have a minimum of two exit doors.
— Temporary stands cannot be located in residential areas or be placed with 150 feet of any resident.
— Fireworks may be sold on or between June 27 and July 5.
— Fireworks may be discharged between 10 a.m. 11 p.m. three days prior to and on July 4.
— A person cannot ignite or discharge fireworks within 1,000 feet of a hospital, on a public roadway, or right of way, or within 20 feet of any residence, dwelling, or other structure.
Four licenses were issued by the commission for fireworks stands within Marion, and began operation this past Monday.
"Common sense is always the biggest issue," said Soyez.
